Terms of Service

Last updated: 1 November 2026

These terms govern your use of parkwestcollectors.com (the “Service”), operated by Kerja Group LLC (“we”, “us”). By creating an account you agree to them. We have kept them short and in plain language; if anything is unclear, ask us before you sign up.

1. What the Service is

A private online record of your art collection, with tools to import purchases from your Park West Clarity account, upload invoices and certificates, print or share a catalog, and list pieces for sale or trade to other members. We are an independent service run by collectors. We are not Park West Gallery and we are not affiliated with, endorsed by, or acting for Park West Gallery.

2. Your account

You must be at least 18 and give us accurate information. Keep your password private; you are responsible for activity on your account. One account per person. Tell us straight away if you think someone else has used it.

3. Membership and payment

Free trial. Your free trial lasts 14 days. We do not ask for a card to start it. When the trial ends, your account becomes read-only until you choose a plan. During the trial the AI can read up to 30 of your documents. A 30-day annual offer, where available, requires a card. Listing on the Exchange requires an annual membership. Listing art that was not bought through Park West costs $25 per item.

Existing trial promises. Members who joined before 12 October 2026 received a 30-day free trial starting on that day and keep the founding price shown to them when they choose a plan.

The Exchange. The Exchange is available once your membership has been paid. Monthly members can browse and buy; listing pieces for sale or trade is part of the annual membership.

Membership is a subscription billed monthly or yearly through Stripe at the price shown when you join. Founding members keep their founding price for as long as their subscription stays active. Subscriptions renew automatically until you cancel. You can cancel at any time from My Account; you keep access until the end of the period you have paid for. We do not refund partial periods, except where the law requires it. If a payment fails we will email you and give you 14 days to update your card before access is paused.

Founding Members. A Founding Member is one of the original first 100 members who make a successful annual payment. Once earned, the badge is kept while any paid membership remains active, including monthly. Jeroen and Kertreena are granted automatically outside the 100. Once allocated, a place never reopens after cancellation, refund or chargeback.

When membership ends. When your membership ends, your account stays open read-only for 30 days. During that time you can view and download your records and you can rejoin. After 30 days your details are permanently deleted. Backup copies are deleted within 14 days after that. A request from you to delete your account is carried out within 30 days.

4. Your data stays yours

You own everything you add to the Service: records, photographs and documents. You give us permission to store, display and process it only as needed to provide the Service to you and, where you choose, to show listings to other members. You can export your full collection at any time and delete your account whenever you wish.

5. Source matching

“Matched to your invoice or Clarity record” means our AI found matching details between the artwork and one of your uploaded invoices or your Clarity record. It does not authenticate the artwork or state its value. Do your own diligence before buying, selling or trading.

6. The Exchange

Between members. The Exchange puts collectors in touch with each other. The price, payment, shipping, insurance and any taxes are agreed and handled directly between the members involved. We are not a party to those transactions, we charge no commission on them, and we do not guarantee any listing, buyer or seller. Once a sale or trade is agreed it is final.

Listings. Listing on the Exchange requires an annual membership. List only pieces you own, describe them honestly, and remove a listing promptly once it is sold or traded. Pieces bought through Park West list free of charge. A piece bought elsewhere carries $25 listing fee, shown before you list it.

An optional escrow service is planned. It is not available. Fees and terms will be published before it opens.

7. Acceptable use

Do not upload anything you do not have the right to share, misrepresent an artwork or its ownership, harass other members, scrape or copy the Service, attempt to gain access to other accounts, or use the Service for anything unlawful. We may suspend or close accounts that break these rules, after warning you where practical.

8. Availability and changes

We work hard to keep the Service running and backed up, but we cannot promise it will be available at all times. We may improve or change features; if we ever discontinue the Service we will give you at least 60 days’ notice and time to export your data. We may update these terms; material changes will be announced by email at least 14 days before they apply.

9. Liability

The Service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, or for losses arising from transactions between members, from decisions made on the basis of information in the Service, or from events outside our reasonable control. Our total liability to you for any claim is limited to the subscription fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Governing law

These terms are governed by the laws of the State of Florida, USA. We will always try to resolve any dispute with you directly and in good faith first.
